From time to time, Tin Can ("we", "Tin Can" or "Company") may offer you the opportunity to refer friends via one or more referral programs (each, a "Referral Program") on the web site located at tincan.kids (the "Site"). Participation in our Referral Programs is subject to the Tin Can Terms of Service, these Terms and Conditions ("Terms"), and any additional terms set out in an individual Referral Program's informational materials.

These Terms may change from time to time, so please review them each time you're interested in participating in a Referral Program. Capitalized terms that are not defined here will have the same meaning given to them in the Tin Can Terms of Service.

  1. Privacy. The personal information collected, processed and used in connection with our Referral Programs will be used in accordance with Company's Privacy Policy. By submitting any personal information (such as a third-party email address) as part of a Referral Program, you represent that you have the appropriate permission and consent.

  2. How the Program Works. Referral Programs may be made available via our Sites from time to time. To participate, visit the applicable Site and follow the instructions provided to refer individuals from your network, such as friends, family members or colleagues. We may limit the number of individuals you may refer per session or for the entirety of the Referral Program. Once a participant makes a valid referral (determined by the Company in our sole discretion), such participant becomes a "Referrer" and will be provided with instructions on how to redeem the applicable rewards (such as a unique referral link ("Personal Link")). For a referral to be valid, referred individuals ("Friends") must complete the referral as described in the referral message.

    We may offer Referral Programs other than those described above. In that case, the informational materials for that particular Referral Program will contain the applicable terms and instructions.

  3. Restrictions. Your participation should be consistent with the spirit and purpose of our Referral Programs. As a participant, you:

    • should not refer yourself or create multiple, fictitious or fake accounts with the Company or participate in the Referral Program as "Friends".
    • should not distribute materials provided for the Referral Program (such as a unique link or code) via mass messages to people you don't know, or via automated systems or bots, coupon websites, or other third-party websites where you don't have express permission from the site owner to do so. Our Referral Programs are intended to reach your bona fide personal and professional contacts.
    • must comply with all terms and conditions of any social media sites you use to distribute Referral Program materials. Additionally, please limit any social media posts of Referral Program materials to your own account page, and do not post in groups, forums, or other media with an audience broader than your friends and/or followers.
    • must comply with all laws when participating in a Referral Program. This includes, without limitation, laws related to unsolicited commercial email and/or text messages, and deceptive advertising.
    • should not act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of our Referral Programs.
    • should not (i) tamper with the Referral Program, (ii) act in an unfair or disruptive manner, or (iii) use any system, bot or other device or artifice to participate or receive any benefit in the Referral Program.
    • are solely responsible for any liabilities arising from your acts or omissions in connection with your marketing, distribution or other use of any Referral Program materials.

    Employees of the Company or any of its or their subsidiaries, affiliates or promotional agencies are not able to participate.

  4. Rewards. The types of rewards you can earn when you make a referral may vary based on the applicable Referral Program. For example, for a valid referral, you will receive one free month of the Party Line Plan and your Friend will receive free shipping. You can earn an amount from these rewards per year that does not exceed the IRS de minimis threshold for third-party payment platforms. These rewards may be redeemed in various forms in the Company's sole discretion.

    Additional restrictions may apply. For example, there may be a limitation on the number of referrals you can make, or if the reward is in the form of a gift card, gift certificate or voucher, it may be subject to the issuer's terms and conditions. Additionally, if the rewards are for the purchase or use of Tin Can's Products or Services, these are subject to Tin Can's Terms of Service. Rewards are subject to verification. The Company may delay a reward for the purposes of investigation. The Company may also refuse to verify and process any transaction for any lawful reason. All decisions regarding eligibility for and rewards earned under a Referral Program will be made by us in our sole discretion.     Unless otherwise stated, rewards are non-transferable, have no monetary value and may not be redeemed for cash. You will be solely responsible for any taxes incurred as a result of earning rewards under a Referral Program.

  5. Other Terms. Unless expressly stated otherwise, rewards are valid for a limited time only. We reserve the right to modify, cancel, deactivate or delete any reward or terminate any Referral Program at any time, for any reason. Referral Programs or rewards are void if restricted or prohibited by law. We may suspend or terminate your eligibility to participate in any Referral Program if you violate any of these Terms, the Tin Can Terms of Service, any other terms applicable to such Referral Program, or if you otherwise engage in an activity that, in our sole discretion, is inconsistent with the spirit and purpose of the Referral Program.
